"You/your/yours" shall refer to the individual client.

- By commissioning me, you automatically agree to the following conditions and terms of service (TOS).
- Using any part of commissioned work from Frutella Orange in any block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space, is strictly forbidden.
- Using any commissioned work for any advertising or profits associated with block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space, is also strictly forbidden.
- Similarly, using any works by Frutella Orange for training, testing or validating any neural network or artificial intelligence (AI), is strictly forbidden.USER AGREEMENT:
- By commissioning me, you agree that you have read, understood and accepted the TOS.
- I will refuse your commission if you disagree with any of these terms.
- If you feel uncomfortable in agreeing to these terms, you may not request a commission.CLIENT:
- You, the Client, will be expected to first read my TOS and understand my general commission prices.
- You may display my work on external sites as long as it is visibly credited and linked back to me.
- You may not upload or host my work in any gallery, portfolio or any other platform that is intended to display your own work only.
- You may not claim my work as your own.
- You may use the artwork for personal use including, but not limited to: avatars, device wallpapers, personal website displays, and profile pictures.
- You reserve the right to print or create an otherwise physical reproduction of the artwork as long as it is for your personal use only (ie. not for sale).
- You may not use the artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.), unless discussed otherwise.
- You are not authorised to change, modify, edit or use my works without my permission.
- You are also not authorised to trace over my work in any way, including the use of the work as a “base.”
- Any harassment in attempts to bargain for a commission (a ‘slot’) is not tolerated. This includes inappropriately worded comments on any of my social platforms, as well as private messages. I reserve the right to place anyone on a blacklist over harassment.
- By placing an order, you agree to these terms and conditions. Please read these terms carefully.ARTIST:
- By commissioning me, you are purchasing my service as an artist only.
- I reserve the right to post your finished artwork in my gallery for any reason unless discussed and agreed otherwise.
- I reserve the right to decline any project or client for any reason.
- I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.I will not create work containing the following:
- Anything considered offensive or bigoted, NSFW, realistic/heavy gore, complex mecha, and nudity (except for non-human characters, and human portraits).
COPYRIGHT
- I retain all copyright over my works. This means I can redistribute, reproduce or use the image as a sample for sales or self-promotion, unless agreed upon otherwise.
- I do not retain ownership to a character unless they are designed, or owned, by me.
- I reserve the right to sign and/or watermark my own work. I will send you a full resolution image (via a Google Drive link), but my signature will remain on the image.
- It is your responsibility for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (i.e. through a watermark) when uploading on external sites.
CUSTOMER PRIVACY
- All commissions are public unless stated otherwise by you, the client.
- If I upload an image of the finalised work, and you wish to stay anonymous, you should notify me beforehand.
- If you wish for a private commission (i.e. I do not upload it anywhere), you must let me know beforehand. There are no additional fees for such request.
- This also means that you must refrain from sharing any such spoilers and details yourself.ORDERING AND PAYMENT
- Before making any payments, you must wait for a response from me in order to discuss details. Contact via email is preferred, but direct messaging on social media is also allowed (SEE CONTACT INFORMATION AT THE END).
- While discussing the details, you should send at least two references and be clear and specific about your request.
- Once your request is processed and confirmed, I will send you a rough sketch. This will be either done on paper or digitally.
- For line art only, you are expected to deposit 100% payment upfront.
- For coloured, shaded and fully rendered pieces, you can either:1. Pay 100% upfront before I begin.
2. Pay 50% upfront before I begin with line art, and the remaining 50% after line art is complete, and before the colours and are added in.- If the sketch is approved by the client, payments will be accepted afterwards.
- I accept payments in GBP (£). While I can help with currency conversions, it is ultimately your responsibility for ensuring these conversions are correct.
- Payments are currently accepted via PayPal invoices or Ko-Fi donations. Only the client's email address for their PayPal account will be required for the invoice methods.
- I will cover the PayPal fees as it is expected from the Artist per PayPal TOS. What you see in the invoice is what you will have to pay.
- I do not accept payment from shared PayPal accounts, unless you are not of legal age and use a parent/guardian’s PayPal account.
- If payment is not made in a timely manner (4 days, unless discussed otherwise), after I have placed an invoice, the commission will be cancelled. Please contact me if there are any delays or issues preventing payment.*REPEATED COUNTS OF COMMISSIONING A PROJECT AND FAILING TO PAY MAY RESULT IN BLACKLISTING.PAYPAL DISCLAIMER:
- Please note that all of my sales are "Digital Artworks" and it is the Artwork's "Intellectual Property" that is purchased by you, the client.
- Nothing is intended by me, or the client, to be physically shipped to them.
REFUNDS:
- Full refunds can be made during the sketch stage if requested.
- Full refunds can also be made if I am unable to start working on your commission. A reason may or may not be given, depending on the situation.
- After the sketch is reviewed, accepted by you, and I have confirmed that I have begun working on your request, there will be no refunds afterwards.
- No refunds will be issued if the work is finalised.CHARGEBACKS:
- Issuing a chargeback is NOT ALLOWED under any circumstances.
- Should your PayPal or Stripe account malfunction, or authorise a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.
- Issuing a chargeback on purpose without my knowledge will immediately result in blacklisting for you, as well as your email address, and anyone sharing your PayPal or Stripe account, including side accounts.SCHEDULES, WORK SPEED AND DEADLINES:
- I may take up to 3-7 days to respond to your initial order inquiry.
- You reserve the right to set a deadline for your commission. This deadline must be disclosed prior to payment.
- Rushed commissions are strongly discouraged. However, if requested, an additional 25% fee will be issued depending on how much work you want your request to have.
- I reserve full rights to decline a project if there is too short of a time allowance. I reserve the right to take up to 4 weeks to begin work on your project, and an additional 4-8 weeks to work on said project as needed.
- If you did not alert me to a deadline, you must not send reminders until a 4 week’s buffer period has passed. Reminders will be ignored if they relate to work that I have prioritized above your project, including other commissions, gift art etc..
- If due dates are discussed, it is also the clients’ responsibility to ensure prompt communication. I will not be held responsible for late delivery.
- Any harassment over my work speed will not be tolerated, regardless of how much time has passed.
- Please note that slots may not be completed in chronological order.
- You reserve the rights to be notified of any delays.REVISIONS AND FEEDBACK:
- I will send you a sketch before any payment is made.
- Work in progresses (WIPs) can be shown anytime during the work process.
- Minor changes can be made anytime (i.e. colour changes, hand gestures, outline thickness), with no additional fees.
- Any major changes requested will come with additional fees.
- Up to two major revisions can be made during the drafting/sketching phase of the commission. Minor adjustments within reason can be made afterwards.
- I hold no responsibility for any unsatisfactory elements of the finalised work if no feedback was given to amend them beforehand.
- In the absence of feedback from the client, any changes to the final piece will be subject to a fee.
- I will not recreate a commissioned piece unless it has been fully paid for.THE FINAL PRODUCT:
- Finalised works will be sent, via email or direct message, as a PNG file in the form of a Google Drive link.
- No refunds will be accepted once the final work has been sent.
- Please note that there may be slight alterations in the samples in my portfolio, and the illustration that you may receive.
- I reserve the right to reject critiques pertaining to artistic skill and stylisation, and if the critique reduces the artistic quality of the piece.
- Credit to me, the Artist, is required when you post or use it on another platform.
- You, the Client, are responsible for saving any information, images, and other digital data I provide.
- Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 2 months. However, I cannot guarantee against device failure, accidental deletion or loss (such events are extremely unlikely to occur).
- I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.
- Feedback of the final product is permitted after completion of the piece, through private messages or comments.
- Any comments that are inappropriate, inflammatory, non-constructive, or disrespectful in any way may result in blacklisting.DELAYS AND CANCELLATIONS:
- I reserve every right to refuse or cancel a commission. While a reason may be given, I am not obliged to give one.
- Persistent demands for the work to be finished will result in longer waiting time.
- Any comments that are inappropriate, inflammatory, or disrespectful in any way, will result in refusal of a commission (if payment has not been made), or result in a cancellation (if payment has been made), with a full or partial refund issued (see REFUNDS section). Repeat offences will lead to an immediate blacklist, including the client's email, social media accounts, PayPal account, and anyone else who shares their accounts (this also includes alternative accounts).
